Habeas Corpus Resurge


I heard this news today on the radio. NPR was playing it every hour.

When I heard the vote 5 - 4, I and I'm sure you knew as well, that the 4 dissenters were Scalia, Thomas, Alito, and Roberts.

Isn't it an amazing thing, we have four Supreme Court justices who will vote in favor of the power of the unitary executive and against habeas corpus. Its stunning. A 600 hundred year old cornerstone of Western civilization and these guys know what's best.

Let me simply add that a McCain Presidency will add a fifth to that Bush II, Bush I, and Reagan selected quartet.

The only good news is that Scalia is now 72.

Supreme Court Lets Guantanamo Prisoners Challenge Detention in U.S. Courts
A divided Supreme Court ruled Thursday that foreign terrorism suspects held at Guantanamo Bay have rights under the Constitution to challenge their detention in U.S. civilian courts.

The justices, in a 5-4 ruling, handed the Bush administration its third setback at the high court since 2004 over its treatment of prisoners being held indefinitely and without charges at the U.S. naval base in Cuba.
