If they overturn Roe then it would return to the States to decide. Or would it? Some legal experts and Court watchers think the Reactionary Majority on the Court is going to go much further and essentially ban Abortion nationwide taking it out of the hands of the States and maybe even out of the hands of Congress. How that would work would be interesting and could have all kinds of deeply troubling consequences for other extremely contentious issues like Birth Control and Privacy itself. It's possible the Courts real target isn't Roe at all but Griswold vs. Conn. that Roe is built on top of and so are all the laws allowing Birth Control and other privacy related issues like LGBTQ rights. If Griswold goes the entire framework for all these rights vanishes. Another route they could use is to grant full Due Process rights to the unborn at all stages of development from Conception on. This essentially makes them citizens even before they're born. This would run directly counter to hundreds of years of Common Law going way back in time. We'll see if this Court is hell-bent on making America over in the image of the Radical religious right then this is their moment. They are also going to widen gun rights and narrow voting rights and these actions are part of their vision. It's possible some of them want armed militas to enforce their vision the way the KKK enforced the reactionary Jim Crow laws in the South for 100 yrs. after the Civil War. I don't believe they'll do this all in this session. Like the Nazis my guess is they'll do it in a measured way layering on one regressive act on top of another over many years. In the end, they'll get where their going andprobably their hope once there is they can keep the lid on the way the Regressive 19th Century pre-Civil War Court did during Slavery. We'll see soon enough.
It's nauseating to read this and thanks for taking the time to spell this out for us. I just wonder when the hell the democrats are going to stop the bullshit and act in the same manner as the GOP. What in the hell are they doing. Bipartisanship is dead, completely dead, pretending that it is not is ridiculous. The Dems have the power now but act like shy babies, I don't get it.
